Police are investigating an incident in which senior official with the Independent Electoral and Boundaries Commission (IEBC) official was Sunday killed in her house in a robbery in Utange, Mombasa County. 

Officials said the deceased Aisha Akinyi Abubakar, 48 was a senior IEBC official based in Kilifi County.

IEBC is yet to issue a statement over the incident.

She and her son Khasim Hassan, 18 were attacked at about 3 am Sunday January 5 at their compound by two suspects, police said.

The son was also seriously injured and admitted in a local hospital, police said.

The gang stole electronic goods from the house before escaping.

Police said they were informed by officials at the Premier Hospital that a victim of robbery with violence had died at the facility.

A team visited there and established that the gang raided the home at about 3 am at Utange Mkunguni and attacked the woman and her son.

One of the attackers wore a face mask.

They gained access to the house by cutting the grills of kitchen window while armed with crowbar and knife.

The deceased was stabbed and cut on the head above right eye while the son cut on the head.

Police said immediately after the attack the gang robbed the deceased of her mobile phone, a 65 inch TV set, sound system and an iPad.

This was after they had also attacked and injured the son, police said.

The son was able to drive the mother to Premier Hospital where she was pronounced dead on arrival while the son was treated and was yet to be discharged.

Police later visited the scene of the attack as part of efforts to trace the gang behind the attack.

Police said they are pursuing various leads into the attack.

A team is combing the area to get the gang.

Prime Cabinet Secretary Musalia Mudavadi has accused politicians who are using courts to frustrate the reconstitution of electoral commission noting that they were driven by malice to the country.

Mudavadi said that there had been a multi sectorial and political agreement on the rebuilding of Independent Electoral and Boundaries Commission (IEBC) and any attempts to halt the process using courts was misguided.

Speaking at the launch of the Information and Communication Technologies Digital Hub and Digital Economy Conference at Kakamega County Polytechnic Mudavadi said President William Ruto and former Prime minister Raila Odinga had agreed for the creation of the IEBC and wondered why some politicians were keen on scuttling the process.

“Majority of the leaders and Kenyans are keen on a new commission and led by President Ruto and Raila have agreed, but there are a few leaders who are hellbent on seeing the country without the election body, their move is driven by malice,” said Mudavadi.

He called on the leaders at had gone to court some using proxies to drop the cases and have the country get a new leadership for the IEBC.

“Apart from any by elections, there is also the need for the country to begin the review of boundaries ahead of the elections,” said Mudavadi.

Mudavadi called on leaders to work had and implement their manifestos in the remaining two year noting the electorates will make their decision based on the remain 24 Months.

“We have already finished two years and there is another two before the electorates make the final decision,there no leader should waste time on unnecessary bickering and empty politics,” said Mudavadi.

He said that the Kenya Kwanza government was on the right track trying to improve the livelihood of Kenya and the country’s economy.

Mudavadi”s issue on the IEBC, echoed by Kakamega governor Fernandez Barassa who called on the need tor the recommend.

During the meeting Mudavadi said the government had put 22000 government services online and noted that he would consider having the recruitment of police be done online as the first stage.

“In the spirit of transparency, we will have the first stage of police recruitment through a digital platforms to cut off middlemen who were making money from the recruitment process.

Mudavadi said also on the pipeline is the having Occurrence Book (OB) at the police done digitally to remove the possibility cases of people plucking pages with the reporting.

“We need to fully embrace online services on all fronts to ensure that we simplify how people work but also weed corruption through the interaction of paper work,” said Mudavadi.

Speaker of the National Assembly Moses Wetang’ula Sunday called for the swift reconstitution of the Independent Electoral and Boundaries Commission (IEBC).

His appeal comes ahead of Parliament’s resumption after its recess.

Speaking to the congregation, Wetang’ula emphasized the urgency of addressing the IEBC issue as there were many pending commission activities which had stalled due to lack of commissioners.

He spoke when he attended a solemn service at Chebukwa Catholic Church in Bungoma County.

“We cannot afford further delays on boundary reviews or pending by-elections in our wards and constituencies. I urge those obstructing this process to reconsider their stance and allow the country to move forward,” he stated.

Wetang’ula also called on the Chief Justice to expedite court cases concerning the IEBC, stressing the need for prompt resolution to avoid further disruptions to the electoral process.

The Speaker’s call comes at a critical time as Parliament gears up to tackle several key national issues, with the reconstitution of the IEBC expected to be a priority on the agenda.

The slow pace of reconstituting the commission threatens many planned reforms and other activities.

In addition to electoral reforms, Wetangula highlighted the importance of consolidating public educational resources, a move he believes could lead to the introduction of free education from primary school through to university.

“If we consolidate our bursaries and funds, we can be able to give free education from primary to university,” he explained,

He reiterated Parliament’s commitment to addressing this issue.

Wetang’ula underscored the need for decisive action, saying, “the work is cut out for us, and we must act now to secure Kenya’s future.”

The Independent Election and Boundaries Commission (IEBC) selection panel that will recruit the electoral body’s Commissioners is taking shape following the selection and forwarding of nine nominees by the five bodies mandated by the newly signed electoral law. 

The selection panel has three months from the day it will be gazetted to finalize its recruitment exercise and forward the names of the nominees to the president and shall thereafter stand dissolved unless its mandate is extended by Parliament.

Plans are that the names will be gazetted by Tuesday July 30.

The three persons nominated by the Political Parties Liaison Committee are Evans Misati representing non-parliamentary parties, Nicodemus Bore from the Majority party and Augustus Muli from the Minority Party.

Dr. Nelson Makanda and Fatuma Saman who were in the previous selection panel have been retained by the Inter-Religious Council.

Andrew Kipkoech Tanui has been nominated by the Institute of Certified Public Accountants of Kenya.

Law Society of Kenya (LSK) nominated Caroline Kituku while Speaker of the National Assembly Moses Wetangula will on Monday officially announce Adams Oloo and nominee from the UDA side nominated by the Parliamentary Service Commission respectively.

The selection panel shall finalize the recruitment exercise within 90 days of its appointment and forward the names of the nominees to the President and shall thereafter stand dissolved.

However, Parliament may, by resolution passed in both the National Assembly and the Senate, extend the tenure of the selection panel for a specified period.

The commission will determine much in terms of planned recalling of Members of Parliament by protesters who are dissatisfied by their performance.

The Independent Electoral and Boundaries Commission (IEBC) has addressed concerns over alleged ghost polling stations in Baringo county.

In a recent statement, the commission refuted the validity of a list circulating on social media, labeling it as both “inaccurate” and “misleading.”

IEBC emphasized that the process of identifying and assigning polling stations for elections entails collaboration with stakeholders.

In a statement, the agency emphasized that stakeholders involved in the process include “political parties and the public.”

IEBC clarified that the total number of polling stations utilized in the 2022 general election was 46,229, noting that each polling station operates within a polling center.

The commission further stated that the list in question is publicly available on the IEBC website.

The controversy surrounding the purported ghost polling stations gained momentum after an investigation by NTV highlighted the presence of ghost schools in Baringo county.

The report featured images of signboards and gates leading to supposed schools in remote areas, devoid of any physical structures like classrooms.

Several of these questionable schools are situated in Barwessa ward, within Baringo North.

The list of alleged ghost schools includes Kaptiony Girls’ High School, Kasaka Mixed Secondary School, Kampi Ya Nyasi Secondary School, and Kasaka Primary School.

The revelation sparked intense online discussions, with some speculating that these schools might have been utilized as polling stations during the last general election.

The national electoral body has gazetted 13 new nominated Members of County Assembly (MCA) for UDA party at the Uasin Gishu County Assembly.

The Independent Electoral and Boundaries Commission at the same time degazetted 13 others who have been serving as MCAs but lost a court battle over the nomination slots.

The move by the IEBC follows an order by High Court Judge Reuben Nyakundi.

Nyakundi last Thursday ordered the IEBC Chief Executive Officer Marjan Hussein Marjan to gazette the new MCAs within 14 days.

In a gazette notice dated January 24 those gazetted as new MCAs at the assembly include Carolyne Jeptanui, Cherono Carolyne, Everlyne Tir op, Naumi Serem, Pamela Jemutai, Sharon Kogo, Burgei Veronica, Celestine Mutai and Rebecca Jerop under the UDA gender top up list.

Others gazetted as new MCAs include Gereld Kiplagat, Tabitha Wambui, Robert Kiptanui and Regina Chumba to be included under the UDA special category list.

Justice Nyakundi has also ordered the speaker of the assembly to immediately swear in the new MCAs at the next sitting of the assembly after their names are gazetted.

Justice Nyakundi had directed that should the IEBC boss fail to gazette the names of the new MCAs within the 14 days then the speaker will proceed to swear them as MCAs.

The new UDA nominees had after the elections moved to the court arguing that their names had been irregularly removed from the original party listed of nominated MCAs before they were gazetted.

The new nominees include people living with disabilities who had been left out by the party list.

Those to be removed and their names degazetted include Naomi Chepkemboi, Roda Kemboi, Rebecca Jerop, Nancy Jemutai, Saida Chepkoech, Sahra Abdi, Magrinah Chebet, Juliet Chelimo and Caroline Cherono who had been nominated by UDA under the gender top up list.

Others whose names have also been degazzetted include Wachira Maina, Belinda Tirop, David Waiganjo and Evelyne Chepkoech who had also been nominated by UDA under special category.

The High Court in Eldoret ordered the polls body to degazette the names of 13 Members of County Assembly (MCAs) who had been nominated by UDA party to the Uasin Gishu County Assembly.

This ignited mixed reactions on those affected. The affected MCAs lost a court battle in which their nomination had been challenged after the last general elections.

Justice Reuben Nyakundi directed that the 13 be degazetted and their names be replaced by 13 petitioners who won the court nomination court battle at the lower courts, High Court and Court of Appeal.

Those to be removed include Naomi Chepkemboi, Roda Kemboi, Rebecca Jerop, Nancy Jemutai, Saida Chepkoech, Sahra Abdi, Magrinah Chebet, Juliet Chelimo and Caroline Cherono who had been nominated by UDA under the gender top up list.

Others whose names will also be degazzetted include Wachira Maina, Belinda Tirop, David Waiganjo and Evelyne Chepkoech who had also been nominated by UDA under special category.

“That in the event of failure to comply with the court orders within the stipulated time the applicants (new nominees) shall be deemed to have been duly nominated and sworn in and they will be at liberty to take up their positions as MCAs at the assembly,” ordered Nyakundi.

Justice Nyakundi directed that the deputy registrar of the High Court in Eldoret under ministerial powers donated by the statute will serve court ruling on the IEBC boss and the assembly for compliance.

The new UDA nominees had after the elections moved to the court arguing that their names had been irregularly removed from the original party listed of nominated MCAs before they were gazetted.

The new nominees include people living with disabilities who had been left out by the party.

The MCAs whose names will be degazetted had served at the assembly for over one year.

The infamous “Cherera Four” were forced to resign, the National Dialogue Committee heard on Thursday.

Former IEBC Commissioners Juliana Cherera, Francis Wanderi, Justus Nyang’aya and Irene Masit told the committee that they were forced out after they questioned the 2022 presidential election outcome.

“It was the commission to tally and the chair (Chebukati) to declare the results. Unfortunately, we were not allowed to do that,” Wanderi said.

Wanderi who was accompanied by Nyang’aya when making his submissions claimed the Form 34c which contained a summary of presidential results from all constituencies was never availed to them.

Former Independent Electoral and Boundaries Commission (IEBC) chairperson Wafula Chebukati and ex-commissioners Abdi Guliye and Boya Molu will not appear before the National Dialogue Committee.

The trio was set to appear before the committee on Thursday.

But according to Chebukati, participating in the dialogue talks would be a “reward for impunity”.

The former IEBC boss said their presence would be a betrayal to IEBC staff who were tortured and murdered over the 2022 polls.

Instead, Chebukati said, a Commission of Inquiry should be formed.

“Prof @abdiguliye @moluboya & I won’t be appearing before the National Dialogue Committee to discuss issues that have been resolved. To participate would be to betray IEBC staff who were tortured & murdered & a reward for impunity. Instead a Commission of Inquiry should be formed,” said Chebukati.

The commission of inquiry, he explained, should be set up to investigate the atrocities of August 15, 2022, at Bomas of Kenya which tainted Kenya’s image.

“The inquiry should also uncover the reasons why some of the Commission abducted, tortured or even killed during the election period; identify persons responsible for those atrocities,” he said.

He added that following the conclusion of the inquiry, proper action should be taken against those found culpable.

Chebukati emphasized that the results of the investigation will strengthen the IEBC’s independence and guarantee that it maintains the status envisioned in the Constitution.

The committee had also invited former IEBC vice chair Juliana Cherera and commissioners Francis Wanderi, Irene Masit and Justus Nyang’aya.

The Office of the Registrar of Political Parties, the Council of Governors, the National Cohesion and Integration Commission, the Media Council of Kenya and Amnesty International were also summoned.

Others were Transparency International and the Kenya Institute for Public Policy Research Analysis.

The 10-member dialogue committee is deliberating issues the Opposition has with the Kenya Kwanza administration.

Other issues on the table are; the high cost of living, an audit of the 2022 general election and the bipartisan reconstitution of the IEBC.

Wafula Chebukati, the former chairman of Kenya’s Independent Electoral and Boundaries Commission (IEBC), has asserted that the country’s General Election held last year was the freest, fairest, and most credible in its history.

Chebukati disclosed that 99.9 percent of Form 34As, containing presidential result data, were scanned and received within 24 hours after the voting day.

He made this revelation during a recent presentation at the “Role of Technology in Improving the Integrity of the Electoral Process in Kenya” conference, details of which he shared on his social media accounts.

The former IEBC chairman highlighted the significance of technological interventions, such as the use of electronic devices for voter identification and result transmission, in enhancing the efficiency and credibility of the electoral body.

He emphasized that the adoption of technology in the election process contributed to its success and reduced tension among Kenyans.

Wafula Chebukati asserted that the 2022 election differed substantially from previous elections he oversaw during his six-year tenure as the IEBC chairperson.

In his presentation, he emphasized the importance of timely and transparent transmission of election results to build trust in the electoral outcome. Delays in result submission, he contended, can lead to misinformation and disinformation, undermining public trust.

Chebukati’s remarks mirrored the recent statement by the US Ambassador to Kenya, Meg Whitman, who praised the country for achieving a historic and credible election.

However, his assertion contradicts the position of the Azimio la Umoja – One Kenya Coalition, which has contended that the 2022 polls lacked credibility and challenged President William Ruto’s victory.
